Section II Buyer's Veterinary Health Exam Deadline:
Section I. Purchase & Transfer Date Information
This dog is being sold to the buyer for the total purchase price shown on this contract. Payment in full is due on or before the Remaining Balance Due date provided above. Failure to pay in full by that date will result in cancelation of the reservation for this dog, and will void this contract.
The buyer may void this contract and cancel the reservation for this dog for any reason until this dog has been transferred from the seller's care into the buyer's care. Request for void/cancel must be completed and the effective date will be the date stamp on that request.
Transfer Date Requirements:
The buyer agrees to take possession of this dog within 3 calendar days of the transfer date above. If the buyer needs additional time before pickup/delivery and the seller agrees, the seller will provide pricing and the buyer agrees to pay in advance for daily care, and for required training for any puppy under 24 weeks of age. The buyer will also be responsible for the cost of all needed veterinary care after the transfer date + 3 days, payable when these services are rendered by a veterinarian. If the seller is not able to hold this dog for the buyer past the transfer date + 3 days, or if the buyer does not fulfill the requirements in this section, the seller reserves the right to void this contract.
If Contract is Void:
In the event this contract is void by either party as stipulated above, payments made* are refundable to the buyer within 10 business days from the void date.
*Exceptions: Reservation fees are not refundable after the buyer has joined a specific litter pick list and signed this contract. Training and care fees paid are fully refundable for dogs who are 8 weeks or younger as of the void date; training and care fees paid are refundable at a pro-rated daily amount for the unused portion for dogs over 8 weeks old.
If at any time prior to the buyer taking possession of this dog the seller is no longer able to provide this dog to the buyer (example: death of this dog), the buyer is entitled to a full refund of the purchase price including reservation fee and any training or care fees, within 10 business days from the void date.
Any refund due will be sent by a mailed check, or processed by reversal to the customer's originating payment method of credit or debit card.
No refunds are available after this dog has been transferred from the seller's care into the buyer's care, except as stipulated in Section III below.
Section II. Veterinary Exam Required within 5 Business Days
This dog was last examined by a veterinarian on the date shown above and found to be in good health and free of illness, injury, and parasites. The details of that exam and this dog's health and vaccination records are attached.
The buyer agrees to have this dog examined by a licensed veterinarian within 5 business days of taking possession of this dog, and to provide the written results of that exam by email attachment to the seller within 15 business days of taking possession of this dog. The exam results must include this dog's microchip number and be signed and dated by the examining veterinarian, with the veterinary office contact information provided. The results must be unredacted (exception: any payment information may be blocked out). These exam results are required to activate the health warranty detailed in Section III, and failure to provide them as stipulated will void that warranty.
Any and all veterinary expenses, with the exception of those stipulated in Section III below, are the responsibility of the buyer after this dog has been transferred from the seller's care into the buyer's care.
The seller is providing 30 days of free pet insurance through Trupanion which can help with the cost of veterinary expenses.
The seller recommends the buyer continue with pet insurance throughout this dog’s life.
Section III. Health Warranty & Refund Policy
This dog is covered by the limited warranty detailed below against life threatening or fatal congenital disorders when diagnosed by four years of age; this dog is further covered against the listed hereditary disorders, when such disorders are diagnosed by four years of age and are causing significant quality of life issues for this dog at the time of diagnosis.
Congenital Disorders:
These disorders are not necessarily hereditary in nature, and are birth defects that can occur during gestation in any dog, regardless of breed. This warranty applies to any life-threatening or fatal congenital disorder diagnosed by 4 years of age.
Hereditary Disorders:
This dog has been DNA tested and/or cleared by parentage for many common hereditary health disorders found in their breed(s). Please see applicable DNA test results attached.
These results do not show any DNA finding that is expected to significantly affect this dog’s quality of life or reasonable life expectancy, and are being provided as part of the seller's normal screening protocols.
In addition, this dog’s parents have undergone physical examination and veterinary imaging evaluation against structural hereditary disorders common in their breed(s), and the results and certifications have been attached to this contract.
The following hereditary disorders are covered under this health warranty when they are diagnosed by 4 years of age and when they are causing significant quality of life issues for this dog at the time of diagnosis: Hip Dysplasia, Elbow Dysplasia, Luxating Patella (Grade 2 or above), Heart Murmur (Grade 2 or above).
Hereditary eye disorders are covered under this health warranty when they are diagnosed by 4 years of age and when they are causing significant and permanent loss of vision at the time of diagnosis.
Diagnosis:
Diagnosis of congenital or hereditary disorders must be made by a licensed veterinarian.
The seller reserves the right to a second opinion by a board certified veterinarian in the relevant specialty, of the seller’s choice and at the seller's expense, for confirmation of diagnosis.
In the event that the board certified veterinarian’s findings do not match the original veterinarian’s findings, the board certified veterinarian’s findings will be accepted as the final and official diagnosis for the purposes of this warranty.
The buyer further agrees that they and their veterinarian(s) will share all test results, x rays, examination results, and any other details of diagnosis and/or treatment with the seller and the seller’s veterinarian(s), before any remedies in this warranty will be applied. Failure to provide this information will void this warranty.
Buyer's Options:
If a diagnosis is confirmed as valid under the terms of this warranty, the seller will offer one of the following remedies:
a. The buyer may choose to return this dog to the seller. The seller will pay travel expenses of the seller’s choice. The buyer will sign the seller’s Contract of Return. After these requirements are complete, the seller will issue a refund by check mailed by USPS first class of the buyer’s purchase price minus any reservation fee or training fees. This refund will be mailed within 10 business days of return of this dog and received signed Contract of Return.
b. The buyer may choose to keep this dog and the seller will pay veterinary costs for treatment or correction of the disorder(s) up to, but not exceeding, the purchase price minus any reservation fee or training fees. The buyer will be required to provide veterinary records for all treatments and corrections, and will give permission for the seller and the seller’s veterinarians to discuss the issue on an ongoing basis with all involved veterinarians for treatment or correction, and payment will be sent directly to the buyer's veterinarians in all cases.
Limitations of Warranty:
The total lifetime refund or payment toward veterinary care for treatment/correction under this contract is limited to the purchase price minus any reservation fees or training fees.
There is no warranty against non-congenital or non-hereditary disorders, or against hereditary disorders not listed in this contract, or against parasites, accidents, illnesses, injuries, allergies or other reactions to food, medications, or environment. This warranty does not apply to any veterinary treatment or prevention within the accepted range of normal and customary care.
Pet Insurance Recommendation:
The seller is providing 30 days of free pet insurance through Trupanion which can help with the cost of veterinary expenses.

Section IV. Temperament and Behavior
This dog has been raised using Puppy Culture, an internationally recognized, positive, safe, and pain-free science-based comprehensive puppy curriculum and socialization protocol. This dog has passed a temperament test and behavior evaluation, and is of verified sound temperament as of the purchase date.
The buyer agrees to continue training as needed throughout this dog's life using positive, safe, and pain-free training methods. The buyer agrees to provide ongoing enrichment opportunities (examples: agility, scent work, trick training, walks, retrieving, swimming, in-home training games, food puzzles), for this dog's mental and behavioral health. This training and enrichment can be through in person or virtual classes, or can be self-directed by the buyer.
The buyer agrees to continue socialization in safe ways, such as playdates with known, stable dogs and continued exposure to different people and places. Such socialization should take into account this dog's age and vaccination status with advice from a licensed veterinarian as needed.
The buyer is advised against public dog parks at any time, because the behavior, health, and temperament of the other dogs is unpredictable and can lead to injury, illness, or trauma for this dog.
The seller does not offer any warranty regarding future behavior, as this is entirely dependent on the buyer's follow through with the recommended continuing training and socialization.
Section V. Proper Lifetime Care
The buyer agrees to provide proper care for this dog throughout its life by meeting or exceeding the following standards of health and maintenance.
1. Feed this dog a balanced diet, homemade or purchased. If purchased, select a food with a 4 star or better rating from Dog Food Advisor, or feed as advised by a licensed veterinarian.
2. Maintain this dog in good health and provide routine and as-needed veterinary care, including but not limited to vaccinations, parasite control, heartworm prevention, diagnosis and treatment of illness and injuries, and any other recommended health care from a licensed veterinarian.
3. Maintain this dog at a healthy weight as advised by a licensed veterinarian.
4. Provide grooming for this dog's health and comfort including regular brushing and combing, bathing and coat trimming, eye and ear care, and nail care.
5. Exercise this dog appropriately based on their age and fitness level.
6. Protect this dog from adverse environmental conditions and all dangers from extreme temperatures or weather.
7. Maintain this dog as an indoor pet, including sleeping indoors at night.
8. Provide this dog with continued socialization, training, and enrichment for their mental and behavioral health.
Failure to provide this care will void the health warranty in this contract.
Section VI. Spay and Neuter
The buyer agrees they will spay or neuter this dog under the terms of the seller's Spay Secure contract. A copy of this contract is attached.
Section VII. Rehoming and Right of Return
The buyer agrees they will not rehome this dog without first contacting the Seller so that any transition can be made in the best interests of this dog. Failure to contact the seller and obtain written permission for the rehoming will void the health warranty in this contract. The new owner(s), once approved, will be required to sign a contract in order to maintain the health warranty.
The buyer agrees that they will not resell this dog for a profit.
The buyer agrees that they will not surrender this dog to a shelter or rescue for any reason.
The seller will accept return of this dog for any reason throughout its life. There is no refund offered for such return, and full ownership of the dog reverts to the seller upon such return.
Section VIII. Payment Policy
The buyer understands and agrees that all payments made to the seller are final and non-refundable except as stipulated in Section I and Section III, and agrees to the refund process and type specified in those sections.
Section IX. Litigation
Any dispute arising out of or relating to this agreement, including any claim for breach of contract, shall be resolved exclusively in the courts located in Forsyth County, North Carolina. The seller and the buyer hereby agree to the exclusive jurisdiction of said courts and waive any objection to the laying of venue in such courts.
